Terms of Service

Welcome to Nders Studio. By initiating a project with us, you agree to the following terms and conditions. These terms govern the relationship between Nders Studio ("Agency") and the Client.
01. Scope of Work
The Agency agrees to perform the services described in the project brief submitted by the Client. Any additional work outside the scope of the original brief will be billed at our standard hourly rate or as a separate fixed-price contract.
02. Payments & Refunds
- Deposit: A non-refundable deposit is required to secure a build slot. Work will not commence until this deposit is received.
- Final Payment: The remaining balance is due upon project completion and before final deployment/handover.
- Refunds: Once development has begun, the deposit is non-refundable. If the Client cancels the project, they are liable for all work completed up to that point.
03. Client Responsibilities
The Client agrees to provide all necessary assets (logos, copy, images) in a timely manner. Delays in providing assets will result in a delay in the final delivery date. The Agency is not responsible for missed deadlines caused by Client delays.
04. Intellectual Property
Upon full payment, the Client grants the Agency a perpetual, non-exclusive license to display the work in its portfolio and marketing materials. The Client retains full ownership of the final website code and design assets.
05. Liability
The Agency is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the website. This includes, but is not limited to, loss of revenue, data, or business opportunities.
06. Hosting & Maintenance
Unless a maintenance package is purchased, the Agency is not responsible for ongoing updates, security patches, or hosting fees after the final handover. The Client is solely responsible for maintaining their hosting and domain accounts.
07. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nders Studio is registered.
